Wills & Probate
A will is a legal document that details what you want done to your property when you pass and appoints someone to manage the estate.
Texas does not tax estates and federal inheritance taxes only apply to estates worth $11.18 million or more. Therefore, most individiuals will not have to pay taxes on what they inherit. However, if the deceased had outstanding debts at the time of their passing, part of the estate must be liquidated to pay what is owed, including taxes.
Probate is the process by which property is transfered from the decedent to heirs. To initiate this process, the will mustt be probated by a court.
An executor or executrix is a person given legal power to dispose of the deceased’s assets. Most wills name their own executor or executrix.
If you die without a will, the government will distribute your property according to law. To ensure your property goes where you want it to, call an attorney to help you write a will.

Every situation is unique but, generally speaking, your debt cannot be transmitted to another person after you die. Debts outstanding at your time of death are repaid during probate.
